GENERAL TERMS AND CONDITIONS — CARNET & CARNINJA (ENGLISH)

  • Carnet is an online marketplace, not a party to transactions. DSA compliance: trader traceability and transparency.

2. Scope of Application

Applies to Carnet.be, CarNinja, ad placement/management/removal, AI features, communication via the platform, and all Carnet services.

Users must be 18+ or have guardian consent (WER/DSA).

3. Services Provided by Carnet

Carnet is an intermediary, not seller/buyer/mediator/inspection body.

We show whether sellers are professional or individual. Ranking based on relevance, date, and paid promotions (DSA Art. 31). No extra transaction fees; external costs borne by users. Carnet proactively checks ads for illegal content.

4. User Categories

4.1 Individuals

  • Up to 2 free ads per year
  • Ads must be for vehicles they own or are authorized to sell
  • Abuse (commercial posting) may lead to removal

4.2 Professional Traders

  • Paid ads unless temporary promotions
  • Carnet may change terms/prices/promotions with 15 days notice and termination right (DSA Art. 14, WER)
  • Must comply with Belgian consumer law (WER Book VI)
  • Traceability (DSA Art. 30 - KYBC): identity verification (name, address, phone, email, ID, bank details, company number, EU-law self-certification) before publishing. Carnet may verify via official databases and stores data for the relationship duration + 6 months. Name, address, email, and phone of garages are displayed publicly.

5. Placement of Advertisements

  • Must be accurate/complete, not misleading, no stolen/damaged/prohibited vehicles
  • Use own photos or photos with rights
  • Carnet may refuse/remove misleading, illegal, fraudulent, low-quality or technically faulty ads
  • Removal notice with reasons (DSA Art. 20); complaints/objections allowed (Art. 16)

6. Editing of Images and AI Descriptions

  • Permission to edit/optimize/crop photos, add watermarks, generate AI descriptions (OpenAI, Gemini, other models), process metadata incl. EXIF
  • AI descriptions are informative and may contain errors/bias (AI Act Art. 50); user remains responsible for accuracy
  • No liability for AI generation/interpretation except gross negligence; risk assessments and human oversight for critical advice (high-risk AI: extra obligations)

7. Duration of Advertisements

  • Online as long as user wants or until sold
  • Carnet may remove for abuse/non-compliance
  • User must remove sold vehicles promptly

8. No Commission on Sales

  • No commission, transaction costs, or sales percentage
  • Sales occur directly between buyer and seller

9. Behavioral Rules

  • No fraud, deception, or illegal trade
  • No publishing others’ data/photos without permission
  • No spam
  • No commercial trade under an individual account
  • No price manipulation or AI abuse
  • Carnet may restrict/suspend/remove accounts with reasons

10. Limitation of Liability

  • Not liable for ad errors/inaccuracies, buyer-seller disputes, hidden defects, damage/loss/lost profits/costs
  • Exceptions: intent, gross negligence, or breach of essential obligations (WER)
  • No guarantees on vehicle condition, info accuracy, or user reliability
  • Platform is “as is” / “as available”; we aim for quick recovery. Platform complies with the Web Accessibility Directive.

11. Intellectual Property

  • User retains copyrights to photos
  • Non-exclusive, revocable license to Carnet for publication, marketing, optimization, AI improvement (as needed, max. 6 months after removal)
  • Carnet owns rights to platform, AI algorithms, generated descriptions, tools, layout, structure, trade names

12. Processing of Personal Data

Processing per the Privacy Policy on carnet.be/privacy, following GDPR (access, deletion, rectification, objection). Data used for accounts, ads, fraud prevention, analytics, improvement, and marketing (with consent).

13. Termination of Accounts

  • Possible for abuse, fraud, breach of terms, repeated complaints, incorrect data, prohibited content, manipulation
  • With reasons and right to complain; users may delete accounts anytime

14. Changes to Services and Terms

Carnet may modify platform/features/terms/prices; notice at least 15 days (DSA & WER).

Users may terminate without costs for substantial changes.

15. Applicable Law

Belgian law only; competent court: Vlaams-Brabant district.

16. Complaints Mechanism and Dispute Resolution (DSA Art. 20-21)

Complaints via info@carnet.be (ad removal, suspension). Handling within 14 days (max. 30 if complex) with human review.

If unresolved: access to certified out-of-court bodies. Annual moderation transparency reports available.

17. Payments and Withdrawal (WER Book VI)

Payments

  • Bancontact, credit card (incl. VAT for individuals; excl. VAT for professionals)
  • Professional users: 14-day withdrawal right for distance services with refunds

Withdrawal Information

Right to withdraw within 14 days from contract conclusion (e.g., premium services).

Notify Hebel & Margo BV, Kapellekensweg 32, 3391 Meensel-Kiezegem, info@carnet.be, Phone: 0493677895 via clear statement (mail/fax/email); model form optional.

Deadline met if sent before the 14-day period ends.

Consequences of Withdrawal

All payments (including standard delivery costs) refunded within 14 days of notice, using the same payment method unless agreed otherwise, without fees.

If service started during withdrawal period: pay proportionally for what was provided until withdrawal.

Exceptions

No withdrawal right for digital content not on a tangible medium once performance begins with express prior consent and acknowledgment of withdrawal loss.

18. Force Majeure

No liability for force majeure (natural disasters, cyberattacks) preventing service.

19. Severability

Invalid provisions do not affect the rest; parties will replace with a valid clause closest to the economic purpose.
